Terms & Conditions of Sale
This CONTRACT that refers to Terms and Conditions of Sale, by and between Coastal Life Home Design, Inc. (hereinafter referred to as Designers), and Client and or assigns (hereinafter referred to as Client).
WHEREAS Designers and Client desire to enter into a contract for certain services, as listed below, and do hereby wish to set forth the terms of said agreement with specificity; NOW THEREFORE, and in the consideration of the mutual covenants herein contained and as stated on the attached “Plan Sale Order Form†and other good and valuable consideration, the parties do agree to the following:
Services:
Designers shall provide to Client as instruments of service, print copies of the Designated Drawings on order, a stock set of construction drawings with requested modifications, that Client intends to build at the following location that is specified in sale order.
Other Terms:
- Ownership of Designs:U.S. Copyright Laws Protect Plans. When you purchase a plan package, you are given a limited use license, more specifically, you are only given the right to modify and use the design and information contained within the plans for constructing ONE HOUSE ONLY. Additional uses may be purchased from Coastal Life Home Design, Inc. , at any time, once payment is received in full. Client agrees to pay a Reuse Fee for any additional uses. A vellum set must be purchased to obtain a limited license for making modifications to these plans.
- Liability of Party:Designer shall not be held responsible for anything in connection with the construction of the proposed design, including, but not limited to construction procedures, safety precautions or injuries incurred before during or after construction.
- Entire agreement: This contract contains the entire agreement of the parties, and there are no representations, warranties, covenants or undertakings other than those expressly set forth herein and can only be amended by further written agreement.
- Binding Effect: Except as otherwise stated herein, all the provisions of this contract shall be binding upon the respective parties, heirs, next of kin, executors, administrators and assigns of the parties.
All Sales are final and plans may not be returned for any reason. Prices for additional black lines or vellums apply only if ordered within 30 days of initial order. Additional shipping charges apply if ordered separately.
